1- Fields and conditions of application

The MOB brand is represented in France by the company ECLECTIC DISTRIBUTION which is a SASU company with a capital of €5,000, whose registered office is located at 89 Route de la Reine 92100 Boulogne Billancourt. It is registered with the Paris Trade and Companies Register under the SIRET number: 90283000900012
Any reproduction, in whole or in part, is systematically subject to prior authorization from c reserves the right to modify these general conditions of sale at any time. In this case, the general conditions of sale in force on the day of the order will be applied to each order.
These general conditions of sale shall prevail over all other conditions appearing on any other document, except in the event of prior, express and written derogation.
Any customer who places an order with MOB implies their acceptance, without restriction or reservation, of the general conditions of sale in force and MOB also accepts them without reservation.

2- Application

These general terms and conditions of sale are intended to govern the contractual relations between www.mob.paris, hereinafter referred to as MOB, and any person making a purchase through the site www.mob.paris, hereinafter referred to as the buyer.
By becoming a member and/or customer, membership in MOB implies full and unreserved acceptance of all the general conditions of sale by checking the box provided for this purpose.

Conversely, MOB undertakes to respect the obligations incumbent upon it under these conditions of sale.

MOB reserves the right to modify its general terms and conditions of sale at any time. In this case, the applicable conditions will be those in effect on the date of the order placed by the buyer.

3 - Registration

Registration is not required to access all products for sale on the site, except for special promotions. Membership is acquired only after identification.

MOB reserves the right to accept or refuse a member or to review access rights at any time.
The new member receives a confirmation email, to the email address previously filled in the form, which validates their registration with MOB .

The member then has a personal account on which he can make purchases.
The member assumes full responsibility for the use and conservation of his password.
In the event of loss, theft or communication of your password to a third party, the member is invited to reset their password via the Contact section.
By registering with MOB , the member agrees to receive by email invitations to sales and newsletters and/or offers from partner organizations and companies.

4 - Products

MOB strives to implement a complete description of the products available through characteristics and photographs.
The characteristics appearing on the descriptive sheets of the products offered by MOB - ECLECTIC DISTRIBUTION are established from the data provided by the suppliers, subject to the validity of the information.

MOB undertakes to provide the most accurate photos possible, but these cannot guarantee perfect conformity with the product. The photographs are for informational purposes only.
In the spirit of perfectibility of the site, MOB - ECLECTIC DISTRIBUTION encourages members to report any erroneous information which could appear on a product sheet.

The products offered for sale are sold for an indefinite period by MOB and while stocks last.

5 - Price

Prices displayed on MOB are indicated in euros and all taxes included.
Product prices do not include shipping costs, except for special operations. Special packaging and any special requests (foreign shipping, express shipping, courier) will be charged. The amount of shipping costs varies depending on the destination, provided that delivery takes place within the geographical area specified below, in Article 10.
The shipping cost is indicated at the time of order confirmation and is subject to acceptance by the buyer. If delivery is stated to be free in a geographic area, the product will therefore not be subject to shipping costs for that same geographic area.

MOB reserves the right to modify its prices at any time, it being understood, however, that the products will be invoiced on the basis of the rates in effect when the order is recorded.

6 - Ordering terms and conditions

The order is only validated when the buyer has double-clicked, in accordance with the law on trust in the digital economy of June 21, 2004: once to place the order and a second time to confirm it. Confirmation will be equivalent to signing and accepting the operations carried out.

MOB then sends an email confirming the recorded order, subject to full payment, then a second email is sent to the member when the products are shipped with the tracking number, depending on the carrier.

7 - Payment terms

Payment for the order is made by credit card or by "tripe".
In case of payment by Tripe, MOB includes commission fees and Tripe's terms and conditions of use apply.

The order confirmed by MOB - ECLECTIC DISTRIBUTION will only be effective upon agreement from the bank payment centers, subject to the suspensive condition of product availability. In the event of refusal by the banking establishment, the order will be automatically suspended and MOB will take care to notify the buyer by telephone or email and reimburse them within 48 hours.

Furthermore, MOB reserves the right to refuse any order from a buyer with whom there is a dispute.

8 - Payment security

MOB uses the SSL (Secure Socket Layer) security system, which effectively encrypts all banking information using software.
No third party has access to confidential payment information. Therefore, the bank details of members wishing to make purchases by credit card will be required for each new order. In any case, following a payment on www.mob.paris, MOB - ECLECTIC DISTRIBUTION does not store or collect its customers' confidential banking information. Credit/debit card numbers are never stored.
Only the Paypal partner banking institution keeps the card number and expiration date.
Additionally, PayPal is the only banking institution to have the most effective fraud control, alert and blocking modules on the market, thus protecting all confidential data related to the payment method.

9 - Unavailability of products

Despite all the precautions implemented, a product ordered and purchased may be unavailable.
In the event that an ordered product becomes unavailable before the end of its shipment, MOB informs the buyer by email, within a maximum of one week, of the timeframe within which this product could be delivered. In any event, the delivery of a product cannot exceed twelve days, subject to full payment of the price.

In the event of permanent unavailability, in accordance with the provisions of article L121.20.3 of the Consumer Code, MOB undertakes to fully reimburse the product, by automatic transfer to the account with which the buyer paid for his order, as soon as possible, at the latest within thirty days from the date of payment of the order.

An email will be sent to the buyer to inform them that their card has been credited and that their purchase is now refunded.

10 - Delivery method

Orders placed on MOB are delivered to mainland France by several different carriers: Colissimo (La Poste), Chrono 18 (Chronopost), Mondial Relay.

In Belgium, Switzerland, Luxembourg, United Kingdom, Spain, Italy, Germany by Colissimo International.

Orders are shipped to the delivery address provided at the time of ordering and only apply to the above-mentioned geographic areas. Neither La Poste nor MOB - ECLECTIC DISTRIBUTION can be held responsible for non-delivery due to an incorrect or incomplete delivery address. Typical average delivery times, which include shipping processing times, are up to five business days.
In any case, delivery times are indicated when the order is finalized and MOB notifies the buyer by email that their package has been shipped.

If the customer is absent during the first delivery, La Poste will leave a delivery notice with their contact details. The fact that the buyer is absent during the first delivery will not be considered a delay. In the event of various cases of force majeure recognized by French case law, delivery times may be extended.

In the event of late delivery, the shipping costs paid by the customer cannot be reimbursed by MOB .

If a package is not received within the specified timeframe and a shipment has been sent, the buyer has 45 days to claim their package. An investigation is conducted by MOB. with the carrier and may take several days. During this period, no refunds or returns can be made.

Once this deadline has passed, MOB will no longer be able to carry out a postal survey.

Upon receipt of your order, we strongly recommend that the buyer check the conformity of the products delivered.

In the event of loss, theft or non-receipt of an order sent, MOB will ask the Customer to provide official supporting documents necessary for the establishment of an after-sales service, MOB will then be able to proceed with compensation which will be made only in the form of CREDIT. No refund can be issued following the loss or non-receipt of a package sent by MOB .

11 - Right of withdrawal

In accordance with the provisions of article L121-20 of the Consumer Code, the buyer has 30 days from the date of receipt to return their order.
If the product is not suitable, the shipping costs remain the responsibility of the buyer.
Returned products that are worn, incomplete, damaged, or incomplete will not be accepted. Returns are accepted if the returned products remain identical to those in which they were shipped, with the original packaging, certificates, and labels.

Reimbursement will be made to the buyer within 30 days of the date of receipt of the withdrawal. For more information, see the Product Returns section.

12 - Warranty and liability

MOB buyers benefit from the provisions of the legal warranty against hidden defects. If the delivered product does not correspond to the description on the product sheet or has a hidden defect, the buyer has the option to return the product.

If the product is defective, damaged or incomplete, the buyer must report it to MOB within 7 days of receipt. The product will be replaced or refunded within thirty days of receipt, depending on its availability or the buyer's decision. In both cases, shipping costs are then borne by MOB.

In the context of a return resulting from a withdrawal procedure, for which the shipping costs are the responsibility of the buyer, MOB reserves the right to be subject to a fixed penalty of 45 euros, added to the reimbursement of return costs.

According to Article 1386-1 of the French Civil Code, only the manufacturer is responsible for product safety. Only suppliers guarantee that the products presented for sale comply with the description provided and that they do not have any hidden defects making them unfit for their normal use. The only contractual guarantee is that provided by the supplier. MOB therefore declines all responsibility in the event of an error in a product description, given that the photos and descriptions illustrating the products on sale are only indicative.

MOB 's responsibility cannot be held liable for any damage resulting from improper use or malfunction.

Furthermore, MOB liability cannot exceed the amount of the product ordered.

No compensation may be requested other than that provided for by the Consumer Code.

If a problem arises, the buyer first contacts MOB in order to obtain an amicable solution. In the event of a dispute, the Nanterre High Court will have sole jurisdiction.

13- Intellectual property

MOB is a protected trademark registered with the National Institute of Intellectual Property (registration number 4218681), the domain name being also protected.
All elements of the site www.mob.paris are and remain the intellectual and exclusive property of MOB .

As such and in accordance with the provisions of the intellectual property code, no one is authorized to reproduce, exploit, rebroadcast, or use for any purpose other than private, even partially, without the agreement of MOB.

Any posting of a simple or hypertext link, using the “framing” or “deep linking” technique to the site www.mob.paris is strictly prohibited.
www.mob.paris or any other part of this site is strictly prohibited from reproduction, copying or exploitation, for any purpose whatsoever, without express written authorization.

Any copying, use for commercial reasons and any parasitism based on the same sales method as MOB is strictly prohibited and may give rise to prosecution and sanctions, in terms of violation of intellectual property rights.

14 - Confidential data

All member information and data is strictly confidential. MOB undertakes to use this information exclusively for the operation of its site. As such, MOB does not undertake to market or rent to a third party any data concerning members. In accordance with the provisions of Article 34 of the "Informatique et Libertés" law of January 6, 1978, members have the right to access, modify, and suspend data concerning them. To do so, the member can exercise it by writing online in the contact section.

MOB undertakes to immediately remove members wishing to leave its database.
